In this case, the petitioner is seeking bail in connection with Uchakagaon P.S. Case No. 33 of 2016 registered for offences under sections 341, 323, 324, 307, 504/34 I.P.C. and later on section 302 I.P.C. was added.

There is case and counter case from both sides with regard to digging a ditch in front of the house and that led to altercation in both sides.

Against the petitioner allegation has been made that he has given a lathi blow on the parietal region of the son of the informant, who became unconscious, brought to Gorakhpur Hospital and during treatment, he died.

Looking to the case and counter case from both sides

Patna High Court Cr.Misc. No.39483 of 2016 (2) dt.17-09-2016 2/2 with regard to digging a ditch and both sides have received injury and the First Information Report shows that it is a case of single blow made by the petitioner, let the petitioner, Bishuni Ram @ Bisuni Ram, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-IX, Gopalganj in connection with Uchakagaon P.S. Case No. 33 of 2016.
