The Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 354(B), 379, 342, 504/34 of the Indian Penal Code. As per F.I.R., all the accused persons including these petitioners surrounded the informant and started assaulting the informant and her son and snatched purse containing cash, mobile, ornaments .
Allegation against these petitioners are general and omnibus in nature. As a matter of fact, informant after taking consideration money, has not executed the land when the petitioners demanded the money, this false case has been
Patna High Court CR. MISC. No.20154 of 2023(2) dt.24-06-2023 2/2 lodged. Informant is in the habit of lodging false cases. Earlier, too she has lodged many false cases namely Chhaurandano P.S. Case No. 101 of 2023, 127 of 2013 and Chhaurandano P.S. Case No. 409 of 2022. Petitioners have got clean antecedent. Learned A.P.P. for the State as well as learned counsel for the informant both have opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances and the fact that there is general and omnibus allegation against the petitioners and the petitioners have clean antecedent, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, East Champaran at Motihari, in connection with Chhauradano P.S. Case No. 409 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure (Prabhat Kumar Singh, J) sanjeev/- U T
