In this case, the petitioner is seeking anticipatory bail in connection with Saran Mahila P.S. Case No.43 of 2019, registered for the offence punishable under Sections 376, 493 and 506 of the Indian Penal Code.

In the present case, the allegation has been made that the petitioner and the informant developed the friendship and on the pretext of marriage, they have entered into sexusal relationship. When the time came for marriage, the petitioner backtrack and has put the obscene photographs in the social media, however, counsel for the petitioner submits that in the FIR, specific allegation of sexual assault has been made against

No.17381 of 2020(4) dt.11-12-2020 2/2 the petitioner, but the statement under Section 164 Cr.P.C. is completely silent on this point as she has stated that she wanted to marry with the petitioner which he denied and, thereafter, the parents were negotiating for marriage in another place and in August 2019 he started putting some obscene photographs in the social media that caused erosion of the family. Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the S.D.J.M, Saran at Chapra in connection with Saran Mahila P.S. Case No. 43 of 2019 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
