Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 366 and 34 of the Indian Penal Code,

Patna High Court CR. MISC. No.30210 of 2021(2) dt.21-03-2022 2/3 registered in connection with Alauli P. S. Case No. 32 of 2020. As per allegation, three accused persons including the present petitioner kidnapped the daughter-in-law (Patohu) of the informant.

The learned counsel for the petitioner has submitted that the daughter-in-law of the informant had love and affair with co-accused Mahesh Bind and she with her own sweet-will went with Mahesh Bind and the petitioner has falsely been implicated.

The statement of the victim was recorded under Section 164 of the Code of Criminal Procedure, in which although she has supported the factum of kidnapping but she has stated that the accused persons did not do anything with her. The petitioner is also a person of clean antecedents. Considering the above-mentioned facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within a period of four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Alauli P. S. Case No. 32 of 2020, subject to the conditions as laid down

Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
