JUSTICE SATYAVRAT VERMA ORAL ORDER 21-11-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 420, 379 and 34 of the Indian Penal Code.

Learned counsel for the petitioner, at the outset, submits that he has instructions to make submission that he is willing to compensate the informant of the losses caused to him, though petitioner is the owner of the truck and as such was not involved in the occurrence and whatever happened, happened in connivance with the driver and other accused persons. The learned counsel for the informant also agrees to what has been submitted by the learned counsel for the petitioner.

No.20725 of 2022(4) dt.21-11-2022 2/3 The learned counsel for the petitioner submits that he will pay the entire amount to the petitioner by 05.09.2023 to which the learned counsel for the informant agrees and the learned counsel for the informant further submits that, in the event, if the entire amount i.e., Rs. 5,29,652/- is paid to him within the period aforesaid, he will also withdraw the case against the petitioner.

Considering the joint submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on provisional bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Patepur P.S. Case No. 231 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

In the event, if petitioner files an application on 05.09.2023 bringing to the notice of the learned trial court that the entire amount as agreed has been paid. The provisional bail of the petitioner shall be confirmed on the same terms and conditions.

No.20725 of 2022(4) dt.21-11-2022 3/3 Learned counsel for the informant, at this stage submits that he will provide the account number of the informant to the petitioner by filing an application in the learned trial court latest by 30.11.2022 and, in the event, if the account number is not furnished by the said date, then the provisional bail granted to the petitioner shall stand automatically confirmed.
