JUSTICE SANJAY KUMAR ORAL ORDER 21-12-2016 Heard the learned counsel for the petitioner and the learned APP for the State.
Petitioner is languishing in custody since 25.04.2016 in connection with Baligaon P.S.Case No.38 of 2015 for offence alleged under Sections 147, 148, 149, 435, 427, 387 and 506 of the IPC, Section 27 of the Arms Act and Section 17 of the CLA Act.
It has been submitted by the learned counsel for the petitioner that petitioner is neither named in the FIR nor put on test identification parade and nothing has been recovered from the possession of the petitioner and his name has transpired in the confessional statement of one Pramod Paswan who has already been allowed bail by a coordinate Bench of this Court in
Patna High Court Cr.Misc. No.47876 of 2016 (3) dt.21-12-2016 2/2 Cr.Misc.No.13670 of 2016 and other co-accused persons, namely, Kamleshwar Rai @ Master Jee and Amarjeet Rai have also been granted bail by a Coordinate Bench of this Court in Cr.Misc.No.45045 of 2016 and Cr.Misc.No.15363 of 2016 respectively and petitioner remained in custody since 25.04.2016 and the case of the petitioner stands on better footing. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances of the case as also that some of the co-accused persons have also been granted bail by this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Vaishali at Hajipur in connection with Baligaon P.S.Case No.38 of 2015.
