The petitioner has renewed his prayer for bail which was earlier rejected vide order dated 29.08.2023 passed in Cr. Misc. No. 10111 of 2023 in a case registered for the offences punishable under Sections 420, 468 of the Indian Penal Code and Sections 8, 20(b)(ii)(c), 20(c), 29 of the N.D.P.S Act.

There is recovery of 62.740 Kgs of Ganja from a Hyundai Verna car and three persons including the petitioners were arrested.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.22618 of 2024(3) dt.26-04-2024 2/3 petitioner petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with the seized vehicle or the apprehended accused persons. The petitioner is languishing in custody since 23.11.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In pursuance to the direction of this Court, a report with regard to the present stage of the case has been received which has been brought on record as FlagA. The report of learned Additional District & Sessions Judge, 1st, Kishanganj dated 03.04.2024 suggests that charge has been framed in this case and the matter is fixed for adducing the evidence which suggests that the trial is not likely to be concluded in near future though in the report, it was mentioned that trial is expected to be concluded within six months.

Considering the facts aforesaid and the period

Patna High Court CR. MISC. No.22618 of 2024(3) dt.26-04-2024 3/3 under custody as well as the petitioner being lady, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 454 of 2022.
