Petitioner is seeking anticipatory bail in connection with Baniyapur P.S. Case No. 468 of 2018 registered for the offences punishable under Sections 414, 420, 467, 468 and 471 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case without there being any material to connect this petitioner with the present Case. Learned counsel further submits that the petitioner has no criminal antecedent.

Learned APP for the State is present and has opposed the prayer for bail.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.18305 of 2019(2) dt.04-04-2019 2/2 wherein the allegation is that when the police party raided the premise of the petitioner it was found that two splendor motorcycles were lying there with their parts opened and the petitioner is unable to explain even prima-facie as to how two motorcycles of the given chassis number and engine number were found in the premise of the petitioner, this Court is not willing to extend the privilege of anticipatory bail to the petitioner. In case the petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered on the basis of the materials available on the record.
