The petitioner is apprehending his arrest in a case registered under Section 302/34 of the Indian Penal Code. Allegation against the accused persons including the petitioner is to have caused death of the daughter of the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The petitioner is the father-in-law of the deceased. He is separate in mess and property from the husband of the deceased. The

Patna High Court CR. MISC. No.21092 of 2019(2) dt.04-04-2019 2/2 husband of the deceased is in custody. The deceased is said to have committed suicide. Hence, no offence under Section 302 of the I.P.C. is made out.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Jamui (Adarsh Thana) P.S. case No.470 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
