2. Petitioner seeks regular bail in connection with S.T. Case No. 405 of 2023 arising out of Hussainganj P. S. Case No. 25/2023 in a case registered for the offence punishable under Sections 393, 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per prosecution case, on 13.02.2023 at about 10:40 P.M., informant along with his brother was going to Hussainpura to attend marriage ceremony and when they reached near Kutub Chapra Chimni, Village-Mahawal, three unknown miscreants riding on the motorcycle intercepted them and tried to snatch motorcycle. Thereafter, one of the miscreants pushed the motorcycle due to which informant and his brother fell down. It is further alleged that one miscreant started firing which hit informant's brother and when informant took his

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR. Name of the petitioner transpired on confessional statement of co-accused Lalu Yadav, who has already been granted bail, by this Court vide order dated 06.12.2024 passed in Cr. Misc. No. 61115 of 2024. It is further submitted that till date, petitioner has not been put on Test Identification Parade. Petitioner is in custody since 31.03.2023.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-II, Siwan in connection with S.T. Case No. 405 of 2023 arising out of Hussainganj P. S. Case No. 25/2023.
