JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 28-09-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

This application for grant of anticipatory bail arises out of Baisi P.S. Case No. 01 of 2016, disclosing offences under Section 409 of the Indian Penal Code.

The petitioners, at the relevant point of time, were Secretaries of the school for different periods ranging from the year 2006 to 2014 of Primary School, Sarva Siksha Abhiyan, Purnea. It is alleged that an amount of Rs. 14,65,590/- was drawn by the Headmaster of the said school with the joint signature of these petitioners for the purpose of construction of school building. Learned counsel for the petitioners has submitted that it appears that the Headmaster of the school, taking advantage of lack of illiteracy of these petitioners withdrew the amount, taking their signatures also and misappropriated the amount. It is his submission that the said Headmaster is in custody. He has also submitted that the petitioners shall make all possible efforts to ensure that the said building is constructed. Considering the submissions as above and the fact that the petitioners are ladies, this application is allowed. Let the petitioners, above-named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri P.K.

Mohit, learned Additional Chief Judicial Magistrate-cum-Sub Judge-II, Purnea, in connection with Baisi P.S. Case No. 01 of 2016, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
