Petitioner, who is in custody, seeks bail in connection with Bahadurpur P.S. Case No. 243 of 2018 registered for the offences punishable under Sections 457, 380 and 411 of the Indian Penal Code.

Allegation against petitioner is of stealing the mobile of the informant.

It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case only on suspicion. He is not named in the FIR. He runs a mobile shop named as Wold Communication to earn his livelihood. The theft was committed

Patna High Court Cr.Misc. No.60887 of 2018(2) dt.05-10-2018 2/2 by co-accused Ritik Kumar who was apprehended and accepted his guilt. He has no criminal antecedent and he is in custody since 04.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Patna City in connection with Bahadurpur P.S.
