NILU AGRAWAL ORAL ORDER 04-04-2019 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of the State. Petitioner seeks bail in connection with Town (Nagar) P.S.Case No.85 of 2019 for the offence alleged under Sections 401, 382 and 411 of the Indian Penal Code. The prosecution case as lodged by the informant is that while she was returning in a three wheeler after getting her grand-son treated at the doctor's clinic, the petitioner sitting her side in the tempo snatched her gold chain. On alarm, she was apprehended along with the gold chain.

It has been submitted by the learned counsel for the petitioner that she is innocent, bears no criminal antecedent and as per the seizure list, the chain has been defined as looking like gold which has yet been ascertained by forensic examination.

However, learned APP for the State opposes the prayer for bail.

Considering the nature of allegations, the period of custody and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Town (Nagar) P.S.Case No.85 of 2019 to the satisfaction of learned Chief Judicial Magistrate at Siwan, District-Siwan (Nilu Agrawal, J) B.Kr./- U T
