JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-09-2015 Heard learned counsels for the petitioner and the State.
The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.
It is alleged that the petitioner on the pretext of illness of maternal grand mother of the victim enticed away the minor daughter of the informant.
It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim has got her age recorded as 19 years when the court has assessed as 17 years where she has stated that she of her own married with this petitioner and considering the stand of the victim the informant
Patna High Court Cr.Misc. No.36743 of 2015 (2) dt.10-09-2015 2/2 has retracted from the initial version and filed a petition to that effect before the court below. The same has been brought on record as Annexure-3.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Danapur, Patna in connection with Naubatpur P.S. Case No. 203 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
