JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 411 of the Indian Penal Code.

Petitioner is not named in the first information report but on the basis of suspicion petitioner was arrested and his confessional statement was recorded leading to recovery of some looted cash from his possession as well as one looted mobile from possession of co-accused.

No doubt, petitioner carries criminal antecedent but submission on behalf of the petitioner is that the recovered cash belongs to petitioner and as a matter of fact, he has been roped in this case by the police. Petitioner is in jail custody since

Patna High Court Cr.Misc. No.38345 of 2016 (4) dt.11-11-2016 2/2 15.03.2016 and investigation against him has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur in connection with Danapur P.S. Case No. 113 of 2016.
