JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-10-2019 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with S.T. No. 83 of 2016, arising out of Amarpur P.S. Case No. 359 of 2015, registered under Sections 147, 148, 149, 341 and 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected thrice on merit, lastly on 21.03.2018 in Criminal Misc. No. 13059 of 2018. Further submission is that the petitioner is in custody since 08.12.2015 but the trial has not been concluded as yet. Further submission is that while the allegation made in the F.I.R. that Pappu Panjiyar shot fire through country made pistol at the

No.20468 of 2019(3) dt.16-10-2019 2/2 temporal region of grandfather of the informant and thereafter, this petitioner shot fire below his chest but in the postmortem report, only one firearm injury was found at the temporal region of grandfather of the informant and no injury either on chest or below the chest was found.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Adhoc Additional Sessions Judge-I, Banka, in connection with S.T. No. 83 of 2016, arising out of Amarpur P.S. Case No. 359 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
