1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Janta Bazar P.S. Case No. 04 / 2025 dated 09.01.2025 registered under Sections 30(a) of the Bihar Prohibition and Excise Act 2016.
3. As per the first information report the police party recovered a total quantity of 87.75 liters of English wine from a Bolero bearing registration no. BR04J-2475 which was coming towards Bihari Mod from Ekma and apprehended one accused person from the said vehicle.
4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case by the police due to oblique motive. The petitioner is neither the owner nor the driver of the seized Bolero. Illicit liquor in question has
Patna High Court CR. MISC. No.24958 of 2025(2) dt.06-05-2025 2/2 not been recovered from the conscious possession and / or vehicle belonging to the petitioner. The petitioner has no criminal antecedent.
5. Regard being had to the submission made by the parties, taking into consideration the nature of allegation, the fact that petitioner is neither the owner nor the driver of the Bolero and he is having clean antecedent accordingly I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of 3rd Exclusive Special Excise Judge, Saran at Chapra in connection with Janta Bazar P.S. Case No. 04 / 2025 subject to the condition as laid down under Section 482(2) of the B.N.S.S. (Anil Kumar Sinha, J) praful/- U T
