This is a petition for grant of anticipatory bail for offence under Sections 25(1-B), A, 26 and 35 of the Indian Penal Code.

The first information report named accused confessed before the police that the petitioner was one of the members who had fled away and so his criminal associate.

Submission of the petitioner is that the petitioner has got no criminal antecedent and the only material is confessional statement of the co-accused before the police. Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Garkha P.S. Case No. 286 of 2016 to the satisfaction of the Chief Judicial Magistrate, Saran, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
