Learned counsel for the petitioner is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.

The petitioner is apprehending his arrest in Jiyapokhar P.S. Case No. 12 of 2020 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 504, 506 of the Indian Penal Code.

Allegation against the petitioner is to have given sickle blow to victim which led to fracture of temporal bone. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the

Patna High Court CR. MISC. No.30586 of 2021(2) dt.07-03-2022 2/2 present case. A petition vide Annexure-2 to this petition has been filed by the informant wherein he has retracted from his earlier statement made in the FIR.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in connection with Jiyapokhar P.S. Case No. 12 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
