The present petition has been filed with a prayer to restore Miscellaneous Appeal No. 577 of 2011 to the extent of restoring the same against respondent no. 3. The Miscellaneous Appeal earlier stood dismissed due to non -compliance of peremptory order dated 5.3.2014 against the respondent no. 3.

After hearing and considering the facts and circumstances, the restoration petition stands allowed. Let Miscellaneous Appeal No. 577 of 2011 be restored against respondent no. 3.

It is made clear that if the order dated 5.3.2014 is not complied with within six weeks, the whole Miscellaneous Appeal
