====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 20-12-2022 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Bihar Staff Selection Commission ( for brevity 'the Commission').

2. The petitioner is aggrieved by his not being selected in the process of appointment of Assistant Teacher, pursuant to Advertisement No. 210 of 2010, issued by the Respondent-Commission.

3. The petitioner has raised a grievance that the College from where he had acquired training, namely, Bhagwan Buddha Primary Teachers Education College, Siwan (Annexure 1 series) has been considered to be a fake Institution whereas another candidate at Sl. No. 24,585 who, as per the

Patna High Court CWJC No.13283 of 2015(3) dt.20-12-2022 2/2 integrated session-wise seniority list of primary teachers, has acquired training from the same Institution finds place in the said list.

4. The Respondent Nos. 3 and 4 has filed a counter affidavit. It is their specific stand that pursuant to judgment of this Court in CWJC No. 17899 of 2012, which was affirmed by judgment dated 24-03-2015, passed in LPA No.1491 of 2014, in which this court directed for constitution of a three men committee under the Chairmanship of Principal Secretary, Human Resources Department, Govt. of Bihar, to look into the grievances of the candidates in the appointment process.

5. The copy of the counter affidavit has been served on the petitioner's counsel as far back as on 25.08.2015. Till date, there is no denial or dispute with respect to this assertion of the respondents. There is also nothing on record to show that the petitioner has availed the remedy of raising his grievance before the three men Committee constituted in compliance of this Court's order. In view thereof, no case is made out.

6. The writ petition is dismissed.
