Petitioner is an accused in connection with Araria (Bairgachhi) P.S. Case No. 1039 of 2019 for the offence registered under Sections 395, 397, 398, 307 and 326 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the instant case on mere suspicion. It is further submitted that name of the petitioner has surfaced on the basis of the confessional statement made before the police by the co-accused, namely Vinod Paswan, which has no evidentiary value. It is further submitted that the petitioner has not been placed on T.I. Parade. Petitioner is in custody since
