The petitioner apprehends his arrest in a case registered for the offences punishable under Section 420 and 406 of the Indian Penal Code.
Prosecution case is that petitioner and complainant entered into a partnership deed at 70% and 30% share for starting a factory of paper-cup in Patna and in this connection he had given Rs. 6,00,000/- to the petitioner but he grabbed the same money and did not start the partnership business till now. It is submitted by learned counsel for the petitioner that the petitioner is an innocent person and has committed no offence. He submits that petitioner is ready to give Rs. 6,00,000/- to the informant in equal four installments within six months.

In that view of the matter, let the above named petitioner, be released on bail, on submission of the affidavit/proof that he has paid first installment of the aforesaid amount i.e. 1,50,000/- to the informant and rest amount will be paid in three equal installments, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Complaint Case No. 224 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. The learned court below will be at liberty to cancel the bail bonds of the petitioner if he fails to deposit next three installments of the aforesaid amount.
