JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-07-2020 Heard Mr. Ranjeet Kumar, learned Advocate for the petitioner and Ms. Pushpa Sinha-I, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Sarai P.S. Case No. 336 of 2019 dated 20.09.2019 instituted for the offences under Sections 467, 468, 471, 420, 504, 506 and 34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that the present case has been lodged because of family dispute. The petitioner is the brother-in-law of the informant. Earlier also, a case was lodged against the petitioner by the informant vide
Sarai P.S. Case No. 36 of 2020, about which reference has been made in paragraph-3 of the bail petition. In that case, the petitioner has been granted anticipatory bail.
The allegations in the FIR clearly reflect that there is a dispute regarding property amongst the members of the same family. Regard being had to the nature of accusation against the petitioner, he is directed to be released on bail, in the event of his arrest/surrender before the court below within a period of six weeks, on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-XIII, Vaishali at Hajipur in connection with Sarai P.S. Case No. 336 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
