JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 188, 147, 148, 149, 153(A), 323, 324, 307, 337, 338, 332, 333, 353, 504 and 506 of the Indian Penal Code.

Petitioner is named in the F.I.R. There is allegation of assault upon another community and their property. Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that twelve persons were arrested on the spot and they have disclosed the name of the petitioner. No specific allegation has been attributed against the petitioner and other co-accused persons having similar allegation have already been granted bail by different Benches of this Court, which are at Annexures-2, 3 and 4 to the petition.

Having heard both sides, in view of disclosure of name of petitioner by co-accused persons and co-accused persons, who have been apprehended on the spot, have been granted bail by this Hon'ble Court, let above named petitioner, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra (Saran) in connection with Rivilganj P.S. Case no. 154 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the investigation and make himself available before the police as and when required.
