Petitioner apprehends his arrest in connection with Bairiya P.S. Case No. 260 of 2016 registered under Sections38(I)/41(i)41(ii) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has been implicated in this case on basis of confessional statement of co-accused, who was in inimical terms with the petitioner. nothing has been recovered from the conscious possession of the petitioner.

Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed

Patna High Court Cr.Misc. No.8461 of 2017 (2) dt.28-02-2017 2/2 to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Bettiah, West Champaran, in connection with Bairiya P.S. Case No. 260 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
