NILU AGRAWAL ORAL ORDER 30-09-2015 Heard Sri. Uma Shankar Singh, learned counsel for the petitioner and learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Bikramganj P.S. Case No. 42 of 2015 registered for the offences punishable under Sections 379, 411, 120(B) of the Indian Penal Code, Section 4/44 of the Mining Act and Sections 33, 41, 42, 51 and 52 of the Indian Forest Act.
The prosecution case is that the Sub-Inspector, Bikramganj Police reported that on 09.03.2015 they searched a truck bearing Registration No. JH02Q/6975 loaded with stone chips and the driver did not produce the valid paper for the materials loaded therein. It is further alleged that the petitioner along with truck driver are found to be involved in illegal mining.

No.39032 of 2015 (2) dt.30-09-2015 2/2 It has been submitted by the learned counsel for the petitioner that petitioner has a clean antecedent and he is the driver of the said truck and the owner of the truck in question has already been granted privilege of anticipatory bail by a coordinate Bench of this Court vide order dated 17-07-2015 passed in Criminal Misc. No. 23118 of 2015.
Under such circumstances, let the petitioner, namely, Nandu Singh in the event of his arrest or surrender within a period of four weeks from today before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bikramganj in connection with Bikramganj P.S. Case No. 42 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
