Prayer in this application is for grant of bail to the petitioner in Alamnagar P.S. Case No. 98 of 2015 registered under sections 47(a) & 47(e) of Bihar Excise (Amendment) Act, 2016.
Ten litres of country-made liquor (Mahua) is/are said to have been recovered from the open Verandah of the house belonging to the petitioner.
It is stated that the petitioner lives jointly with other family members. It was an open verandah. He is in custody since 18.07.2016 having no criminal antecedents.
In the facts and circumstances of the case, let the

No.48095 of 2016 (2) dt.02-12-2016 2/2 petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the SDJM, Uda-Kishunganj, Madhepura in Alamnagar P.S. Case No. 98 of 2016 on condition that one of the bailors of the petitioner shall be his own/close family member. In the event of framing of charge, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel his bail bonds and secure his arrest in accordance with law. (Kishore Kumar Mandal, J) HR/- U T
