The petitioners seek bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 26.40 litres of country liquor was recovered from the joint possession of the petitioners. It is contended that the petitioner no. 1 has been made accused in another case, i.e., Bihara P.S. Case No. 51 of 2014 registered for the offences under Sections 341, 342/34, 325 and 307 of the Indian Penal Code but that is not of Excise Act and the petitioners no. 2, 3 and 4 have no criminal antecedent. Patna High Court Cr.Misc. No.62753 of 2018(2) dt.08-10-2018 2/2 is urged that the petitioners are in custody since 05.08.2018. Considering the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on their furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Saharsa in connection with Nauhatta P.S. Case No. 125 of 2018 (Special Case No. 405 of 2018) with a condition that if the petitioners, after their release in this case, are again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of their bail bonds.
