JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2017 This is an application for grant of anticipatory bail for offences punishable under Section 304 of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that he has been made accused in the present case on the basis of village politics. Nothing has been recovered from the house of the petitioner that he is a professional doctor.

Heard learned A.P.P. also.

Heard both sides. From perusal of the F.I.R. and the impugned order it appears that the deceased on injury on leg had come before the petitioner who administered some injection and after some time the deceased died. This is not a case for grant of

Patna High Court Cr.Misc. No.8133 of 2017 (2) dt.27-02-2017 2/2 anticipatory bail.

However, petitioner is directed to surrender in the court below, i.e., learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Deep Nagar P. S Case no. 226 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court. This application accordingly stands disposed of.
