JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-07-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State and learned counsel for the informant.
Petitioners apprehend their arrest in connection with Birpur Police Station Case No. 84 of 2014 registered for the offences punishable under Section 147, 148, 149, 323, 324, 325 and 307 of the Indian Penal Code.
Taking note of this fact that altogether four persons
Patna High Court Cr.Misc. No.44383 of 2014 (5) dt.31-07-2015 2/2 sustained injuries and out of them one injured sustained four injuries on his head and, furthermore, some injured sustained injuries by sharp cutting weapon, I am not inclined to grant privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail in connection with Birpur P.S.Case No. 84 of 2014, pending in the court of Sub-Divisional Judicial Magistrate, Birpur, Supaul stands rejected. However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
