JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-02-2015 The petitioner has renewed his prayer for bail in a complaint case in which processes have been directed to be issued after cognizance being taken under Sections 498A, 120B of the I.P.C.

It is alleged that petitioner was found in objectionable condition with the husband of the complainant. On protest being made by the complainant she was being assaulted when her pregnancy got terminated.

It is submitted by learned counsel for the petitioner that the issue has been reconciled between the complainant and her husband and considering the same the provisional bail was granted to the husband of the complainant vide order dated 02.09.2013 passed in Cr. Misc. No. 23409 of 2013.

This Court is not inclined to entertain the second anticipatory bail application filed after two years of first

Patna High Court Cr.Misc. No.42978 of 2014 (2) dt.18-02-2015 2/2 anticipatory bail application. However, keeping in view of the fact as submitted by learned counsel for the petitioner that complainant has settled the issue with her husband and petitioner being lady, let learned Court below consider regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Complaint Case No. 272(C) of 2010, pending in the Court of learned Chief Judicial Magistrate, Supaul.

Accordingly the application is disposed off.
