The petitioner seeks bail in connection with S.T. No. 31 of 2025, arising out of Amarpur P.S. Case No. 110 of 2016 instituted for the offence under Sections 3, 4 & 5 of the Explosive Act.

On the night of 05-04-2016, a bomb explosion occurred around 11-12 PM, injuring Manoj Kumar Singh. As per the prosecution case, Manoj was making bombs near the river along with Mahesh Singh, Nandan Singh (petitioner), and others when the explosion happened. His associates fled from the spot, leaving him injured, and Manoj managed to return home on his own.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 20-10-2024. Petitioner bears one criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no eye witness to the occurrence. No incriminating article has been recovered from the possession of the petitioner. It is submitted that save and except confessional statement of co-accused, namely, Manoj Kumar Singh, name of the petitioner has transpired. Learned counsel for the petitioner mainly submits that similarly situated co-accused has been granted bail by this Court vide order 21-08-2018, passed in Cr. Misc. No. 35382 of 2018, hence, petitioner may also be enlarged on bail.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Other witnesses have supported the prosecution case. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and claim based on parity, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on

No.19237 of 2025(2) dt.08-04-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with S.T. No. 31 of 2025, arising out of Amarpur P.S. Case No. 110 of 2016, subject to the following conditions:

(I) One of the bailors shall be own/close member of the family of the petitioner.

(II) The petitioner shall appear on each and every date fixed at the trial. In case of default in such appearance on two consecutive dates, the Trial Court will have liberty to cancel the bail bonds of the petitioner.
