2. The petitioner apprehends his arrest in connection with Patepur (Harlochanpur) P.S. Case No.136 of 2025, dated 13.05.2025, registered for the offence punishable under Sections 96, 137(2) of the B.N.S.

3. As per the FIR, Raju Singh reported to police that his 16-year-old daughter, namely Priyanka Kumari, was allegedly kidnapped during a village marriage ceremony by the petitioner and other co-accused persons, in conspiracy with each other and with wrongful intentions.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that from the statement record under Section 183 of the B.N.S.S., it appears that the

No.19773 of 2026(3) dt.19-05-2026 2/3 victim, after being tortured at her parent's house, decided to leave and came out of house on her own sweet will on 11.05.2026 at 05 p.m. along with Vikram Kumar, who is petitioner in this case and was studying with her. Even at the time of release, on query being made to her, she has expressed her willingness to go with this petitioner and there is no allegation of any sexual assault or any torture being caused to her by this petitioner. Lastly, it is submitted that the petitioner has no criminal antecedents.

5. On the other hand, the learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

Taking into account the fact that the victim refused to give her statement as well as to undergo medical examination, which was required to be conducted by the prosecution, and further considering that the victim herself had left the legal guardianship of her parents and accompanied the petitioner voluntarily, without there being any allegation of sexual assault or torture against the petitioner, and also considering the judgment of the Hon'ble Apex Court in State of Uttar Pradesh vs. Anurudh & Anr. reported in LiveLaw (SC) 29, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below
