JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-01-2017 By an order, dated 03.12.2015, passed by learned Additional Sessions Judge I, Bhagalpur, in Sabour Police Station Case No. 10 of 2015, the plea of the petitioner for declaring him a juvenile has been rejected. The petitioner is accused of commission of offences punishable under Sections 342, 376D and 506 of the Indian Penal Code, Sections 3 (i) (xii) 2 (V) of the Schedule Castes and Schedule Tribes (Prevention of Atrocities) Act and Section 4 of the Protection of Children from Sexual Offence Act, 2012.
Upon perusal of the impugned order, I find that the Medical Board found the age of the petitioner to be more than 18 years as on the date of occurrence.
