JUSTICE SANJAY PRIYA ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Sasaram Town (Darigaon) P.S. Case No. 905 of 2016 instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504, 354(b) of the Indian Penal Code and Section 27 of the Arms Act. There is specific allegation against the petitioner in the written report of causing firearm injuries to the son of the informant Nikhil Kumar.
The Sessions Judge has mentioned in the impugned order that son of the informant sustained three lacerated wound over left side of chest lower size 1/2" x 1/2" x bone deep and he was referred to higher centre for treatment. Patna High Court Cr.Misc. No.10053 of 2017 (2) dt.08-03-2017 2/2 injuries on the person of son of the informant. In such circumstances, this Court does not find it a fit case for grant of anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner stands rejected.
The petitioner is directed to surrender before the court below and pray for regular bail.
