The petitioner seeks bail in Korma P.S. case No. 52 of 2018 registered under Section 323, 324, 307 and some other Sections of the Indian Penal Code and under Section 27 of Arms Act.

The informant named eight persons, including the petitioner, and alleged that they, armed with pistol and gun, came near the temple of Bajrang Bali. Co-accused Gulli Ram ordered to kill Akhilesh Ram. Gulli Ram and others opened fire at Akhilesh Ram. When Akhilesh Ram tried to flee away Gulli Ram fired which hit on his thigh.

The learned counsel for the petitioner submits that petitioner is not the assailant. The petitioner is, of course, alleged

Patna High Court Cr.Misc. No.61640 of 2018 (2) dt.08-10-2018 2/2 to be member of mob, having armed with weapon, but no specific allegation of firing is made against the petitioner. Akhilesh Ram got only one fire arm injury on his thigh which is attributed to Gulli Ram.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is in custody since 31.07.2018, the petitioner, above named, is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheikhpura in connection with Korma P.S. case No. 52 of 2018.
