Heard the parties in virtual Court.

The petitioner is languishing in custody for the offence punishable under Sections 272/273/120(B)/34 of the Indian Penal Code, Sections 8(c)/20/21/22 of the N.D.P.S. Act and Sections 30(a) and 37(b) of the Bihar Prohibition and Excise Act.

Recovery of ganja and liquor was from the field and house of the co-accused Ram Ishwar Rai. Ram Ishwar disclosed that the petitioner and 21 others are co-culprits. Petitioner has stated on oath that he has got no criminal antecedent. Investigation of the case is already complete. Since there is no direct material against petitioner's

Patna High Court CR. MISC. No.30658 of 2021(2) dt.22-10-2021 2/2 involvement, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Meenapur P.S. Case No. 460 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
