The sole petitioner, who is in custody since 14.7.2016 in Vaishali P.S. Case No. 157 of 2016 registered for the offence under Section 399, 402 of the Indian Penal Code and Section 25 (1-B) a, 26 and 35 of the Arms Act , has prayed for grant of bail. It was submitted by learned counsel for the petitioner that petitioner was not apprehended from the place of occurrence whereas as per information the informant who is a police officer states that three persons were arrested and two persons fled away. From arrested person arms were recovered and it is the case of the informant that the arrested persons disclosed the name of

No.42951 of 2016 (2) dt.06-10-2016 2/2 petitioner and one another person and thereafter police conducted raid in the house of the petitioner and petitioner was arrested from his house however from his possession nothing was recovered. Keeping in view the fact that nothing has been recovered from possession of the petitioner nor he was arrested on the spot and his name has come as per confession of the coaccused person, there is no reason to further detain the petitioner. Let the petitioner Ramanand Rai be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hazipur / concerned court in connection with Vaishali P.S.
