JUSTICE SANDEEP KUMAR ORAL ORDER 06-08-2025 Heard the learned counsel for the petitioner, learned APP for the State and the learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Pipra P.S. Case No. 356 of 2023 registered for the offence under Sections 304(B)/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have assaulted the victim.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 26.12.2023.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Though the petitioner and others are said to have

Patna High Court CR. MISC. No.27232 of 2025(3) dt.06-08-2025 2/2 assaulted the victim and killed her but from perusal of the postmortem report, it appears to be a case of suspected poisoning. There is no ante-mortem injury on the body of the deceased.

7. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

8. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, East Champaran, Motihari/concerned Court below in connection with Pipra P.S. Case No. 356 of 2023.
