The petitioner is apprehending arrest in a case registered for the offences punishable under section 47(a) of the Excise Act.

From the courtyard of the petitioner 200 liters of spirit was recovered.

It is submitted by the learned counsel for the petitioner that the recovery is from the open area and jointly family property. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the

Patna High Court Cr.Misc. No.36793 of 2015 (2) dt.11-09-2015 2/2 learned court below in case the petitioner surrenders within six weeks from today in connection with Mashrak P.S. Case No. 206 of 2015 pending in the court of learned CJM, Saran at Chapra. This application is disposed of with the aforesaid observation/direction.
