The petitioner is apprehending his arrest in connection with Sheikhpura P.S. Case No. 370 of 2016, registered for offences punishable under Sections 147,148,149,341, 323, 307, 386 and 506 of the Indian Penal Code.
The allegation against the petitioner is of assault and demand of extortion.
It has been submitted on behalf of the petitioner that the petitioner has been falsely implicated in this case due to political rivalry and there is allegation of kidnapping but the concerned person has returned and that suggests the falsity of the prosecution case.
Heard learned A.P.P. He opposes the prayer for anticipatory bail stating that there is allegation of assault and demand of Rangdari and there are as many as ten other cases lodged against the petitioner.
Having heard both sides and in view of the allegations and criminal antecedent against the petitioner, this is
Patna High Court Cr.Misc. No.16887 of 2017 (2) dt.20-04-2017 2/2 not a fit case for grant of anticipatory bail, rather, the petitioner should surrender and pray for regular bail which will be considered on its own merit without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
