Petitioner seeks bail in Case No.C2-93 of 2018 instituted for the offence under Section(s) 20-B of the NDPS Act. It is alleged in the prosecution report that while petitioner was asked to stop the vehicle during vehicle checking, he threw the polythene towards bush. The Excise Officials searched out the polythene from bush and 100 Gr. Ganja was recovered from the polythene.

Counsel for the petitioner submits that as per prosecution report 100 gr. Ganja was recovered from the bush. Petitioner has been arrested by the police merely on suspicion. Petitioner is in custody since 10.09.2018 having

Patna High Court Cr.Misc. No.64688 of 2018 (2) dt.01-11-2018 2/2 clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge-cum-Special Judge, Sheohar, in connection with Case No.C2-93 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
