The petitioner, who is in custody, seeks bail in connection with Kudra P. S. Case No. 222 of 2016 registered under Sections 20 (B) (ii)(A)/27(A) of the Narcotic Drugs and Psychotropic Substances Act.
Prosecution case, in brief, is that 140 grams of Ganja was recovered from the house of the petitioner alongwith some notes and weighing machine.
It is submitted by learned counsel for the petitioner that recovery of small quantity of Ganja is not from the conscious possession of the petitioner and the petitioner has no other criminal antecedent except one case of Narcotic Drugs and Psychotropic Substances Act in which he has been acquitted.

No.47753 of 2016 (3) dt.07-02-2017 2/2 Having considered the aforesaid facts and circumstances, in particular, recovery of 140 gram Ganja, the petitioner, named above, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions JudgeCum-Special Judge, Kaimur at Bhabua in connection with Kudra P.S.Case No. 222 of 2016.
