The petitioner seeks bail in connection with Mahila P.S. Case No. 60 of 2019 (POSCO Case No. 89 of 2019) for the offence under Sections 4 of POSCO Act.

Learned counsel appearing for the petitioner submits that earlier the prayer for bail of this petitioner had been rejected by this Court vide order dated 24.01.2020 passed in Cr. Misc. No. 3230 of 2020. In fact, charges in this have been framed against the petitioner and there is no allegation of tampering with the witnesses against the petitioner. Moreover, some witnesses have been declared hostile and some of them including the victim have not

Patna High Court CR. MISC. No.31392 of 2021(2) dt.04-08-2021 2/2 supported the allegation as alleged in the F.I.R., which is evident form Annexure-4 series. The petitioner is rotting in judicial custody since 05.11.2019.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned Additional District & Sessions Judge, Sasaram, Rohtas, in connection with Mahila (Rohtas) P.S. Case No. 60 of 2019 (POSCO Case No. 89 of 2019.
