====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Buniyadganj P.S. Case No.129 of 2018 registered under Sections 406 and 420 of the Indian Penal Code. The accusation is that Kapura Devi, the wife of the informant Sunil Yadav, is connected with Jivika Samooh, which is being run by the State Government. The petitioner took Rs.10,000/- from the wife of the informant and Rs.5000/- each from 37 persons connected with Jivika Samooh for providing loan but neither the loan was sanctioned to them nor petitioner returned the money to them.

Learned counsel appearing on behalf of the petitioner

Patna High Court Cr.Misc. No.62325 of 2018(2) dt.06-10-2018 2/2 submits that the petitioner is neither connected with Jivika Samooh nor any person of Jivika Samooh made complaint against the petitioner. The petitioner has falsely been implicated in this case due to dirty village politics. The petitioner having no criminal antecedent is in custody since 03.07.2018. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, Gaya, in connection with Buniyadganj P.S. Case No.129 of 2018.
