Petitioner apprehends his arrest in connection with Mahila P.S. Case No. 38 of 2016 registered under Sections498A, 323, 379 of the Indian Penal Code. The allegation against the petitioner, who is the husband of the informant, is that he used to take liquor and come home with girls. On protest, petitioner tortured and assaulted the informant. Lastly, informant was ousted from her matrimonial house.
Learned counsel for the petitioner submits that in fact the informant was not ready to live in joint family and started pressure upon the petitioner to live separately. Petitioner tried to settle out the situation, however on being failed, he filed
Patna High Court Cr.Misc. No.50831 of 2016 (2) dt.20-12-2016 2/2 Divorce Case No. 40 of 2014 which is still pending. Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Begusarai in connection with Mahila P.S. Case No. 38 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
