The petitioner is apprehending arrest in a case registered for the offences punishable under sections 147,148,149,307,302 and 120B of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the petitioner and other accused persons assaulted the cousin brother of the informant and subsequently shot him dead.

It is submitted by the learned counsel for the petitioner that the prosecution witnesses including the informant have not supported the accusation during trial of the co accused

Patna High Court Cr.Misc. No.35800 of 2015 (2) dt.04-09-2015 2/2 and one of the assailants and the same set of witnesses have been cited against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Ara (Town) P.S. Case No. 359 of 2014 pending in the court of learned CJM, Ara. This application is disposed of with the aforesaid observation/direction.
