The petitioner apprehends his arrest in connection with Paharpur P. S. Case No. 01 of 2017 instituted under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016. The allegation, in brief, is that near the house of the petitioner, 02 litres of country made liquor and two bottles spirit were recovered.

Learned counsel for the petitioner submits the said recovery is not from the possession of the petitioner and it was kept in an open place and he has no criminal antecedent. Having considered the said facts and circumstances let the petitioners, above named, in the event of arrest or surrender before the court below within four weeks from today, be released

Patna High Court Cr.Misc. No.5658 of 2017 (2) dt.07-02-2017 2/2 on bail upon furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Paharpur P.S.Case No. 01 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
