The petitioner is apprehending his arrest in connection with Barauni P.S. Case No. 128 of 2009 for the offence registered under Sections 406, 409, 420, 467 and 468/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that though he was not named in the first information report, subsequently during the course of investigation, the name of the petitioner has surfaced and as a consequence thereof, he is facing prosecution.

No.66039 of 2018(3) dt.19-12-2018 2/3 It is further submitted that the present petitioner was also proceeded against departmentally and in that proceeding, after thorough investigation, the Enquiry Officer submitted his findings to the then Bihar State Electricity Board, now the Bihar State Power (Holding) Company Ltd. Patna, vide Letter No. 61 dated 16.08.2011 stating that none of the charges were found proved against the present petitioner. It is further submitted that the present petitioner has been exonerated from all charges levelled against him. Learned counsel for the petitioner, thus, submits that he is willing to cooperate in whatever further investigation and in the trial which would ensued in pursuance of the present case, as such, he may be extended the privilege of anticipatory bail.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest/surrender before the learned counsel below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 128 of 2009, subject to the conditions as laid down under
